Mark S. Schuver is a shareholder at Mathis, Marifian & Richter, Ltd. with over 30 years of experience practicing in the areas of personal injury and employment litigation, product liability, will & trust disputes and commercial litigation.
Mark has achieved success in winning multi-million dollar personal injury and product liability claims, including wrongful death, truck accident and motor vehicle accident cases, slip and fall injuries, product defect lawsuits and other serious personal injury claims. In addition to representing individuals, Mark also routinely advises employers on a wide range of employment-related issues, such as the Family Medical Leave Act, the Americans with Disabilities Act, workers’ compensation, Title VII, personnel policy manuals and severance, non-compete and non-solicitation agreements. Mark has represented both employers and individuals in employment matters in both state and federal courts, as well as before various administrative agencies, including the Equal Employment Opportunity Commission (EEOC) and the Illinois Department of Human Rights.

Practice Highlights
- Trotter v. B&W Cartage Co., Inc., Not Reported in F.Supp.2d, 2006 WL 1388754, S.D.Ill., (No. 05-CV-205). In this trucking accident case in which a 21 year old student was tragically killed when a tractor-trailer truck crossed the median of an interstate highway, Mr. Schuver and Mr. Niehoff successfully obtained one of the most farreaching punitive damages decisions in the country affecting the trucking industry. By establishing that the trucking company had permitted violations of federally mandated hours of service rules, improper driver logs, and the failure of management to adequately monitor drivers hours of service thereby condoning fatigued driving, Mr. Schuver and Mr. Niehoff were able to obtain a significant settlement on behalf of their clients while also sending a clear signal to the trucking industry reinforcing the Federal Motor Carrier Safety Regulations and official Regulatory guidance issued by the Federal Highway Administration.
- Hadley v. Central Illinois Bank, Mr. Schuver, Ms. Grandy and Mr. Niehoff obtained in excess of $20 million in recoveries on behalf of their client, alleging the loss of million of dollars of rare coins and precious metals.
- Kasiar v. Plumley, 03-L-540 (St. Clair County, Illinois); Mr. Schuver and Mr. Niehoff obtained a $3.1 million trial verdict in favor of their client.
- Toennies v. Terra Properties, Inc., 01-L-892 (Madison County, Illinois); Mr. Schuver and Mr. Niehoff obtained a significant settlement on behalf of their client in this wrongful death action.
- Sanders V. Landau, S.D.Ill., Sep. 23, 2002, 3:02cv01035 (Torts/Negligence – Personal Injury – Motor Vehicle, KNOS 430.75.15; NOS 350); We successfully obtained recovery on behalf of next-of-kin for wrongful death of a father in motor vehicle accident.
- Clifton v. Casino Queen, Inc., Not Reported in F.Supp.2d, 2006 WL 644769, S.D.Ill. (No. 05-CV-129); Mr. Schuver successfully represented various employees of the Casino Queen in their claims of racial discrimination, retaliation and unlawful employment practices.
- Masda Corp. v. Empire Comfort Systems, Inc., 2003 WL 21467237 (3rd Cir. N.J. 2003);
- Mr. Schuver successfully obtained judgment in favor of MM&R’s client in this alleged breach of distributorship agreement case filed in New Jersey. The judgment was subsequently affirmed by the United States Court of Appeals for the Third Circuit.
- Bernard Korando, et al v. Gertrude Marshall, 06-CH-51 (Randolph County, Illinois 2008); Successfully obtained jury verdict in the amount of $440,000 on behalf of client in case alleging breach of fiduciary duty, fraud, intentional infliction of emotional distress, invasion of privacy and claims for punitive damages.
- Beverly Flores, Plaintiff, v. Flying J, Inc., a/k/a/ Flying J Travel Plaza, Defendant., 2008 WL 2062909; This is an action brought for discrimination under the Pregnancy Discrimination Act.
- Johnie Eiland and Vincent Wade, Plaintiffs, v. Arctic Food Services, Inc., d/b/a Arctic Food Services, Inc.,/Panske Arctic Food Services, Inc./Panske Trucking, Inc., a corporation, and Panske Trucking, Inc., a corporation, Defendants., 2008 WL 872752; Action brought for discrimination based upon national origin and race.
- Erika Renee Riley-Jackson, et al. v. Casino Queen, Inc., 2007 WL 4837596; Mr. Schuver represents a large group of current and former African-American employees of the Casino Queen alleging racial discrimination, retaliation, hostile work environment and other unlawful employment practices.
- John Johnson, Plaintiff, v. Casino Queen, Inc., a corporation, Defendant., 2006 WL 5124938, 2006; Mr. Schuver successfully represented an employee of the Casino Queen alleging racial discrimination and wrongful termination for asserting his rights under Title VII of the Civil Rights Act of 1964.
- Donald H. Wild, Jr., Plaintiff, v. Alco Industries, Inc., d/b/a Ehrhardt Tool and Machine, Inc., Defendant., 2006 WL 5124934, 2006; Successfully represented client in claim for discrimination based upon disability and retaliation brought under the Americans with Disabilities Act.

- Bank of Illinois v. Allied Signal Safety Restraint Systems, 75 F.3d 1162, (7th Cir.(Ill.) Feb 02, 1996); Mr. Schuver successfully obtained judgment on behalf of his client in this product liability action involving a defective seat belt.
